Goetz Platzer LLP’s partners, Donald J. Carbone and Gerard Strain prevailed in fending off more than $12 million dollars in claims of an owner and well-known construction manager against one of our large trade contractor clients. In fact, it was the owner which had to pay Goetz Platzer’s trade contractor client for breach of the underlying trade contract. The arbitration required 42 hearings over a period of three years, before a panel of three arbitrators who ruled in favor of Goetz Platzer’s client.
The arbitration involved the Culture Shed in Hudson Yards, which was a $200 million project. The issues in the case were extremely complex in that they involved intricate architectural details, redesigns, sketches, specifications, shop drawings, change orders, scheduling, sequencing, trade stacking, contractual conditions precedent, labyrinthine contract provisions and principles of law, wrongful termination, insurance, billing, the practicalities of the day-to-day happenings on a construction site, and nearly every issue that could arise, both legally and factually, on a large, complex construction project.
After hours upon hours of preparation with the client whose involvement in the case was an intricate and essential part of the win, and through hundreds of admitted exhibits with post-hearing briefs that totaled more than 220 pages, Donald and Gerard were able to pick apart the baseless claims of the owner and its construction manager and substantively prevail on the counterclaims of our trade contractor client.
